Welcome to Ribach e.U. ("we," "us," "our"). These Terms of Use ("Terms") govern your use of our mobile games and related services ("Services"), which are available exclusively to players residing in the United States, United Kingdom, Canada, Australia, and New Zealand. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Age and Residency Restrictions

• Eligibility: Our Services are intended only for individuals who are 18 years of age or older and reside in the United States, United Kingdom, Canada, Australia, or New Zealand. By using our Services, you confirm that you meet these requirements.
• Prohibition for Other Regions: Our Services are strictly prohibited for all players who do not reside in the allowed countries. This includes, but is not limited to, residents of the European Economic Area (EEA), who are explicitly prohibited from using our Services. If it is discovered that a resident from an unauthorized region, particularly from the EEA, is accessing our Services, their account will be deleted immediately.

2. Account Creation and Security

• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.
• One Account Per Player: Each player is allowed to create only one account, which is used for all of our games, and you may not share your account with others.

3. License to Use Our Services

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use our games solely through the official Apple App Store or Google Play Store and in accordance with these Terms.

• No Reverse Engineering: You agree not to reverse engineer, decompile, disassemble, or modify any part of the Services or our backend systems running in the cloud.
• No Bots or Unauthorized Software: You may not use any automated means, including bots, scripts, or other software to interact with our games or access our backend. Only the software provided by us through the App Store or Google Play is permitted for accessing our Services.
• No Illegal Copying: You may not copy, distribute, or reproduce any part of the Services in any unauthorized manner.

4. Restrictions on Use

• Prohibited Activities: You may not engage in any activity that:
  • Violates these Terms, applicable laws, or the rights of others.
  • Circumvents any security or authentication measures.
  • Exploits, modifies, or cheats in our games, including any form of hacking, unauthorized access, or data mining.
  • Uses our Services in any way that violates any third-party rights, including intellectual property rights.
• Illegal Use: Anyone using our Services in a manner inconsistent with these Terms, including but not limited to players residing outside the permitted countries, is doing so illegally. We reserve the right to delete any account that violates these Terms. This includes, but is not limited to:
  • Accessing or using our Services from unauthorized regions.
  • Attempting to bypass age or residency restrictions.
  • Engaging in activities that are not allowed under these Terms.

5. Intellectual Property

• Ownership: All rights, title, and interest in and to our games, including all content, features, designs, code, and technologies, are owned by Ribach e.U. or its licensors. This includes, but is not limited to:
  • Game Content: All visual elements of the game, such as graphics, artwork, animations, and user interface designs.
  • Game Code: The underlying source code and software that make up the game, including any updates or enhancements.
  • Audio Elements: All audio components, including sound effects, music, and voiceovers.
  • Trademarks and Logos: Any trademarks, logos, and branding associated with the game or Ribach e.U. (Note: see Disclaimer of Endorsement and Affiliation for third-party trademarks and logos.)
  • Patents and Innovations: Any patents or patentable inventions, methods, and technologies used in or related to the game.
  These elements are protected by intellectual property laws, including copyright, trademark, and patent laws. By using our Services, you do not acquire any ownership rights in these intellectual property assets. Instead, you are granted a limited, non-exclusive, non-transferable, revocable license to use our games as described in these Terms.
• License Restrictions: You may not use, distribute, or exploit any part of our Services for commercial purposes or in any manner inconsistent with the limited license granted under these Terms.

6. Termination and Account Deletion

We reserve the right to suspend or terminate your account and access to the Services at our discretion, without prior notice, if:

• You violate any of these Terms, including but not limited to reverse engineering, illegal copying, or using bots.
• You access our Services from a prohibited region or if we discover that you are under the age of 18.
• You engage in any illegal activities while using our Services.

Upon termination, all rights and licenses granted to you under these Terms will immediately cease, and we may delete your account and all associated data.

7. In-Game Purchases

• Virtual Items: Our games may offer in-app purchases, including virtual items, currency, or other goods. These virtual items have no real-world monetary value and cannot be redeemed or exchanged for real money.
• All Sales Final: All in-app purchases are final and non-refundable unless required by law.

8. Data Collection and Privacy

We collect and process personal information in accordance with our Privacy Policy. By using our Services, you agree to the collection and use of your data as outlined in the Privacy Policy.

• Deletion of EEA Resident Data: As our Services are not intended for EEA residents, if we discover that an EEA resident is using our Services, we will delete their account and all associated personal data in accordance with applicable laws.

9. Disclaimers and Limitation of Liability

• Disclaimer of Warranties: Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Limitation of Liability: To the maximum extent permitted by law, Ribach e.U. will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ribach e.U., its affiliates, licensors, and service providers, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.

11. Updates to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and the "Effective Date" at the top will be updated. By continuing to use our Services after such changes take effect, you agree to the revised Terms.

12. Governing Law and Dispute Resolution

These Terms and any disputes related to your use of our Services will be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles.

• Jurisdiction: Any legal dispute or claim arising out of or relating to these Terms or your use of the Services shall be exclusively resolved in the courts of Vienna, Austria.
• Dispute Resolution: You agree that any disputes arising out of or in connection with these Terms will be resolved by binding arbitration in Vienna, Austria, in accordance with the rules of Austrian arbitration institutions, unless prohibited by local laws in your jurisdiction.

13. Disclaimer of Endorsement and Affiliation

Ribach e.U. is an independent entity and is not affiliated with, endorsed by, or in any way connected with Apple Inc., Google LLC, Amazon Web Services (AWS), or any other third parties, unless expressly stated. The use of any third-party names, logos, products, or services in our games is solely for identification purposes and does not imply any endorsement or affiliation.
